Drunk driving and drug use causing problems on Louisiana roads

Problems associated with driving under the influence of alcohol are not new to Louisiana. However there is a new wrinkle in the issue and that involves driving under the influence of drugs instead of, or in addition to, alcohol. According to a new study, one in four Louisiana residents engages in drunk driving and/or driving high.

A task force established by the governor is looking at the situation and trying to establish guidelines to improve safety for everyone on Louisiana roads. Drivers pulled over on suspicion of DWI are also sometimes suspected of using marijuana or opioids. The state is not able to prosecute a person who has a legitimate prescription for a medication, even though the prescription may urge precaution when operating machinery.

The task force is looking at different ways to measure a person's level of impairment when behind the wheel. One option that may be available in the future is a marijuana breathalyzer that is under development. Another option may be the development of an additional charge, DUID (driving under the influence of drugs).

In light of all of the changes that may be taking place, a person who is arrested in Louisiana and suspected of driving under the influence of alcohol and/or drugs may be afraid and unsure of what one's rights may be. In such a situation, an accused individual would do well to seek the counsel of an experienced criminal attorney. A knowledgeable lawyer can review the facts of the case and advise the client regarding the current laws and local court procedures for a drunk driving and/or drugged driving charge.
